These terms apply to ArtInAR: the service at artinar.app, the ArtInAR plugin for WordPress and WooCommerce, and the ArtInAR app for Shopify. By connecting your store or creating an account, you accept these terms.
1. Who we are
ArtInAR is a service of Roesware, De Stuwdam 69K, Amersfoort, the Netherlands. Chamber of Commerce (KvK) 63316250, VAT NL002395401B05. You can reach us at [email protected].
2. What ArtInAR does
ArtInAR turns photos of artworks from your online store into 3D models and hosts a preview page for each artwork. From that page your visitors can view the artwork in augmented reality, at the size you entered for the product, using the AR viewer built into their phone. The plugin and the app add a button and an optional QR code to your product pages that link to that preview page.
ArtInAR is meant for businesses and independent professionals who sell art, such as artists, galleries, art lending services and print shops. It is not meant for consumers.
3. Your account and store connection
- You can connect a store without creating an account in the usual way. The connection itself is your account; an email address is optional.
- You must have the right to connect the store you connect. You stay responsible for everything that happens through your connection.
- You can end the connection at any time: revoke the ArtInAR key in WooCommerce (WooCommerce → Settings → Advanced → REST API) or uninstall the Shopify app. To have your account and data deleted, email us.
4. Plans and payment
- Free plan. The free plan covers a limited number of artworks (currently 5), has no end date and needs no payment details.
- Paid plans. Paid plans cover more artworks. The current plans and prices are shown on artinar.app and in your dashboard when you order. Payments are handled by Stripe.
- Renewal and cancellation. A paid plan renews automatically at the end of each period (monthly or yearly) until you cancel. You can cancel at any time; the plan then stays active until the end of the period you have paid for. Amounts already paid are not refunded, unless the law requires it.
- After cancelling. Your account falls back to the free plan. Artworks beyond the free plan's limit may no longer be converted or shown.
- Price changes. We may change prices. A change applies from your next period, and we tell you at least 30 days in advance.
5. Your artwork and content
- You keep all rights to your artwork, photos, product texts and logo.
- You give us permission to store, process and display that content as far as needed to provide ArtInAR: to make 3D models from your photos, to host them, and to show them on the preview pages and in AR. This permission ends when you delete the content or your account.
- You confirm that you have the right to use the artwork and photos you offer in your store, and that showing them through ArtInAR does not infringe anyone else's rights.
- With your permission only, we may show your store or an artwork from it as an example on our website or in our marketing.
6. Fair use
You may not use ArtInAR for content that is unlawful or infringes other people's rights, nor try to disrupt, overload or circumvent the service or its limits. If you do, we may suspend or end your access.
7. Availability
We do our best to keep ArtInAR available and working well, but we cannot guarantee that it is always available or free of errors. AR depends on the visitor's phone and browser; not every device supports it. We may change and improve the service. If we stop a part of the service that you pay for, we tell you in advance and refund the unused part of your period.
8. Liability
Our liability is limited to the amount you paid us in the 12 months before the event that caused the damage. We are not liable for indirect damage, such as lost profit, lost sales or lost data. These limits do not apply if the damage was caused by our intent or gross negligence.
9. Privacy
How we handle personal data is described in our privacy policy. Where we process personal data on your behalf, such as data of visitors to your preview pages, we do so only to provide ArtInAR. A data processing agreement is available on request.
10. Changes to these terms
We may change these terms. We publish the new version on this page and tell you about important changes at least 30 days in advance. If you do not agree, you can cancel before the change takes effect.
11. Applicable law
Dutch law applies to these terms. Disputes are submitted to the competent court in the district of Midden-Nederland.
